How Does Proposition 65 Affect Casters?

If you’ve ever seen a warning label that says “This product contains chemicals known to cause cancer in the state of California” -- then you’ve experienced the effects of California’s Proposition 65.The overall purpose of Proposition 65 is to inform Californians about the existence of substances or chemicals that may cause cancer or birth defects -- a good thing by all accounts. Because California makes up a large percentage of the U.S population (and spending dollars) -- Prop 65 impacts the labeling of many products nationally.

What Does Prop 65 Mean for My Business?

This means that companies with greater than 10 employees that intend to or currently sell products in California have to give a clear warning if they know that their product may contain one of over chemicals determined by the Office of Environmental Health Hazard Assessment (OEHHA) to cause reproductive harm, birth defects, or cancer. This includes casters.

And as of August, 2018, Proposition 65 has revised its parameters for what constitutes an adequate warning. According to JDSupra, some of the major updates to Prop 65 include:

  • The warning must include a black exclamation point in a yellow equilateral triangle with a black outline.
  • The word “WARNING” must appear in bold print and in all capital letters.
  • The warning must include the full chemical name of at least one chemical found in the product that is identified by OEHHA that is known to cause cancer or birth defects or other reproductive harm.
  • If the product contains a chemical on both lists, at least one chemical from each list must be identified.
